Manuscript
The piano score is in Paine's hand, the original of which is at Harvard. It is not in a final state, and the reader is advised to consult the AR Editions printed edition for the 1905 revision. The Autograph is presented here with small adjustments of placement of page numbers, etc. to allow it to be enlarged by 111% in letter size. No content changes were made. As for my hand-copied violin part, it is copied from the Paine piano autograph, not from a free-standing violin autograph part [which may not exist]. According to "Copyright Term and the Public Domain in the United States/1 January 2012" by Peter B. Hirtle, since the work is unpublished and the author died before 1942, the work is in pd in the U.S. at the least.
- The work is actually published. Under the standard legal doctrine of publication, all extant versions of a work are published at the same time of first publication (of any version, even an arrangement). The above assertion that the work is public domain in the USA due to it being an early version fails to account for this. Carolus
